NOTE ON HONG KONG IMMIGRANTS CONTROL

ORDINANCE, 1949.

1.

(a)

This Ordinance

revises and consolidates previous legislation

relating to the entry into and residence in the

Colony of persons not born in Hong Kong;

(b) provides for better control of aliens;

(c) provides for a check on the movements of

persons not born in the Colony.

2.

No person may enter the Colony without either

(a) valid travel documents,

or

(b) valid Entry Permit Certificate of Residence

or Frontier Pass.

The possession of valid travel documents implies

(An

no right to enter or to remain and the Immigration Officer

has discretion to limit the stay of any immigrant.

immigrant is defined as anyone not born in the Colony and

in possession of documentary proof of such birth).

3. No person may enter the Colony except

(a) at an authorised landing place or point of en..

and (b) under and in accordance with a permit of the

Immigration Officer.

The Immigration Officer may prohibit the entry of

various categories of undesirable immigrant of which the

following are the more important:-

(a) diseaseä, destitute, vagrant and prostitute personɛ

(b) persons likely to promote sedition or to

disturb public order;

persons without employment or prospects thereof;

(d) persons precluded from entry into the Colony under

any enactment in force

(0) persons required to be but not in possession of

valid travel documents.
